1. Agreement to Terms

By accessing or using AdSpark, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the platform.

2. Description of Service

AdSpark is a SaaS platform that provides tools for Meta Ads product research, AI-powered landing page generation, ad creative generation, campaign management, and analytics. Features are subject to change and availability depends on your subscription plan.

3. User Accounts

You must create an account to use AdSpark. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You may not share your account with others — one account per user. AdSpark reserves the right to terminate accounts that are found to be shared.

4. Subscription and Billing

AdSpark offers free and paid subscription plans. Paid plans are billed monthly or annually as selected at checkout. You may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for unused portions of a subscription period, except where required by law.

5. Acceptable Use

You agree not to use AdSpark to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Create or distribute spam, malware, or misleading content
  • Attempt to reverse-engineer or circumvent platform security
  • Resell or sublicense the platform without written consent

6. Third-Party Integrations

AdSpark integrates with third-party services including Meta, Shopify, OpenAI, and Luma AI. Your use of these services is governed by their respective terms of service. AdSpark is not responsible for changes to third-party APIs that may affect platform functionality.

7. Intellectual Property

The AdSpark platform, including its software, design, and content, is owned by AdSpark and protected by intellectual property laws. AI-generated content produced through our platform using your inputs belongs to you, subject to the terms of the underlying AI providers.

8. Limitation of Liability

To the maximum extent permitted by law, AdSpark shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the platform, including but not limited to loss of profits, data, or goodwill.

9. Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms. You may terminate your account at any time from the Settings page.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or the competent courts of the jurisdiction in which AdSpark is incorporated.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or a prominent notice on the platform. Your continued use after changes constitutes acceptance of the new Terms.
